Terms of Use

These Terms of Use ("Terms") govern your use of the BrushQuote mobile application and related services ("Service") provided by BrushQuote ("we", "our", or "us"). By downloading, installing, or using BrushQuote, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use BrushQuote. By using the Service, you represent that you meet these requirements.

2. Account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.

3. Subscription and Billing

Free trial. New users receive a 3-day free trial with full access to all features. You will not be charged during the trial period.

Paid plans. After the trial, continued access requires a paid subscription at $10/month or $79/year. All payments are processed through Apple's App Store.

Renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date.

Cancellation. You can cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.

Price changes. We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

4. Acceptable Use

You agree to use BrushQuote only for lawful business purposes related to creating proposals, invoices, and client communications for painting and home service work. You agree not to:

• Use the Service for any illegal or fraudulent purpose
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Share your account credentials with others
• Use automated tools to access the Service without our written consent

5. Your Content

Ownership. You retain ownership of all content you create using BrushQuote, including proposals, invoices, photos, voice recordings, and business information.

License to us. By using the Service, you grant us a limited license to store, process, and transmit your content solely to provide and improve the Service. We do not use your content for advertising or sell it to third parties.

AI-generated content. BrushQuote uses artificial intelligence to help draft proposals from your walkthrough data. You are responsible for reviewing and approving all AI-generated content before sending it to customers.

6. Sharing and Delivery

When you send a proposal or invoice through BrushQuote via email, SMS, or share link, you are responsible for ensuring you have the recipient's consent to receive the communication. We deliver messages on your behalf but do not verify recipient consent.

7. Intellectual Property

BrushQuote, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand elements.

8. Disclaimer of Warranties

BrushQuote is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. You use the Service at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service or other users. You may stop using the Service at any time by cancelling your subscription and deleting the app.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms or the Service will be resolved in the courts of Malaysia.
